1. General Rules
1.1 Purpose
The purpose of this ruleset is to formulate unambiguous criteria for registration, administration and conflict resolution regarding second-level domainnames under the .dk domain, with the purpose of ensuring that the domain-nameservice for the top-level domain .dk can function as effectively and transparently as possible.

1.3 Background
This document is published by Dansk Internet Forum (DIFO), which has responsibility for registration and use of Internet domain names under the .dk domain. This document may at any time be modified by DIFO, at which time the latest version will be published on DIFO's homepage, www.dk-hostmaster.dk.

1.4 Definitions

. Dansk Internet Forum (DIFO): A self-owned institution, having responsibility for registration and usage of Internet domain-names under the .dk domain. Responsibility has been delegated to DIFO by ICANN/IANA. 
. DK Hostmaster: An Limited Company, which is 100% owned by DIFO, and which registers second-level domain-names as delegated by DIFO. 
. Domain check: The control of applicants' domains and servers, carried out by DK Hostmaster in accordance with point 2.8 of this document. 
. DNS test: The inspection of the registrar's or zone-contact's main-domains, which DK Hostmaster carries out by checking for validity one or more the registrar's zones, as described in point 5 of these rules. 
. Domain name: A label consisting of the letters A to Z and/or numerals 0 to 9 and with the possbile use of one or more dashes (-) as separators, and with a total number of characters between 1 and 63, and followed by a top level domain name , for example ".dk". For local-rulesets the name is used alone to describe domain-names under the .dk domain, which thereafter ends with ".dk". 
. Domain notification: The written notification, in which an applicant who wishes to register a domain-name via a registrar supplies the required information to the registrar, who in turn maintains this information for DK Hostmaster. An electronic application form for this purpose can be found on DK Hostmaster's web site. 
. Host application: The application submitted by the zone contact regarding acceptance of a nameserver for the domain under the .dk domain, in accordance with point 3.1 of this rule set. 
. IANA/ICANN: An international organisation, created as a private enterprise, which in accordance with the decisions set forth in RFC 1591 and IPC1 attempts to coordinate certain international Internet activities, with particular focus on top-level domain-names. 
. Board of Appeal: The body which in accordance with part 5 of this rule-set has authority to process disputes regarding domain-names under the .dk domain. 
. Registrar: The company or person, who has approval from DK Hostmaster to register second-level domain-names under the .dk domain either for itself or for others. 
. Registration application: An application for approval as a registrar under the .dk domain. 
. Applicant: A company or person, who via registration with DK Hostmaster through a registrar, has gained the right to use a domain name on the Internet. 
. RFC (Request for Comments): Original description for a draft published for the purposes of generating comment. The name for a series of documents which contain the Internet standard and other information concerning the Internet. For local-rulesets the RFC 1591, titled "Domain Name System Structure and Delegation" is especially relevant. 
. Zone contact: A company or person, who is registered with DK Hostmaster as responsible contact-person for one or more of the nameservers approved by DK Hostmaster. 
1.5 Conflict Resolution
All claims against DIFO and/or DK Hostmaster, which may arise from this ruleset and which are not covered those conflict procedures covered in chapter 5, must be addressed by Sø- og Handelsretten in Copenhagen, which is hereby agreed to be the rightful venue.

Cases arising as a result of this ruleset must be decided based on Danish law and Danish Parliamentary principles.

2. Registration of Domainnames for Use
2.1 Conditions
Registration of domainnames for use under the .dk domain takes place after the "first filed, first served" principle. Such a registration does not imply any physical test of the registration's legitimacy.

A domain name can only be registered for use provided that:

. Information notification is correct 
. The applicant has submitted that information as described in point 2.2.b. 
. Notification is submitted via an authorised registrar. 
2.2 Process
. Place of notification: An applicant who wishes to register a domain must submit the domain notification to DK Hostmaster via a registrar. 
. Duty to supply information: The applicant must at the time of application supply the following information: 
applicant's name, company type, address and telephone number, where applicable 
the desired domain name 
if yearly fees are due then the information which is required to enable such a payment to be automate - the applicant's physical or digital signature as guarantee that the use of the domain-name by the applicant does not infringe name or trademark rights of third parties, or otherwise infringe Danish law. 
. The registrar must maintain the domain notification in a form electronically accessible by DK Hostmaster and in one of the file formats as defined by DK Hostmaster, or in a written form in a secure archival system. In the event that this information is only held in written form, then the document originals must be supplied on demand to DK Hostmaster by the registrar. If the registrar ceases to operate, then all domain notifications must be surrendered to DK Hostmaster. 
. Procedure: The domain notification must be provided to DK Hostmaster on a notification form specified by DK Hostmaster. However before submission the registrar must have carried out tests to ensure that the domain name is available in the DNS. The required test is to be carried out via DK Hostmaster's web site (under the link "DNS Opslag"). 
DK Hostmaster employs a tracking system to register the order in which notifications arrive to DK Hostmaster. On receipt of a notification, DK Hostmaster sends a reference number generated by the tracking system to the registrar as proof of receipt of the notification and of the order of receipt.

. Registration: Once DK Hostmaster has searched its database and established that the requested domain name is not in use, and established that the conditions for registering are fulfilled, then the domain name is registered as in use by the applicant. As DK Hostmaster does not carry out any form of examination of the domain name, registration does not imply rights over or ownership of the name and trademark rights etc that may be associated with the domain name. 
. Collection: Prior to activation of the domain name it is expected that the registrar has paid any due registration fees, or that there are sufficient funds on deposit with DK Hostmaster to cover these, as covered in point 3.3.a. 
2.3 Fees
. Registration fee: On registration of a domain name for use under the .dk domain the registrar must pay a registration fee of 150 kroner plus moms (25%) to DK Hostmaster. This fee also covers the applicant's yearly fees for the current year. 
. Yearly fees: In order to cover DK Hostmaster's costs, the applicant shall pay a yearly fee of 40 kroner plus moms, to be collected 12 months after billing of the registration fee. It remains the applicant's obligation to inform DK Hostmaster of a valid and current electronic post account, to be used to send the account via email, by at the latest ten months after registration. Payment of the yearly fees gives the applicant the right to make ongoing changes to the information recorded about the domain name, without further cost, including for example changes of nameserver or modification of company or personal information. Non payment of yearly fees gives DK Hostmaster the right to delete the domain name in accordance with rules covered in point 2.4. Yearly fees contribute towards financing those costs incrued by DK Hostmaster in ongoing DNS administration and with operation of the Domain Name Board of Appeal. 
2.4 Annulment of Domain Name Registration
A registered domain name can at DIFO's descretion be deleted, given one or more of the following conditions. 
. There exist judicial decisions from Danish or international courts of arbitration or tribunals, or valid demands from public authorities. 
. The domain name is used in clear contravention of Danish law or the rules published by DIFO, and there is a request from the appropriate authorities for removal of the offending registration. 
. Unpaid yearly fees due DK Hostmaster. 
. The applicant neglects to respond to a request, as covered in point 2.9, subsection 1. 
. The applicant neglects to fulfill obligations as covered point 2.2.b. 
. The applicant neglects to fulfill his obligations concerning the name service for the domain, including the obligation to maintain DNS service on at least two DK Hostmaster authorised nameservers. 
. If there exists reasonable doubt as to the owner of a domain name which is registered for use, or the named owner's address is unknown, then anyone with a legal interest therein may demand the domain name deleted. Prior to deletion DK Hostmaster must request the registered owner to make himself known, within a given time, as determined by the department of Patents. Notification of this deadline is made via registered letter or similar. If the owner's address is unknown then the deadline is announced by public notice in "Statstidende". If the owner by this time has not made himself known then the domain name is deleted. 
Prior to deletion of registrations due to the reasons listed in points b - g, a demand will be sent via normal and registered post to the applicant at the address listed on the domain notification, or to a subsequently provided address. The applicant has thereafter eight weeks from the date of the postmark to correct matters. If this is not done, then DK Hostmaster can without further warning delete the registration and make the domain name available to other applicants. 
Upon failure to fulfill the obligations listed under point f. the registrar will be informed of the possibility of the domain name being transferred, without charge, to another zone contact, as decided by the registrar, in accordance with point 2.6 (Redelegation of domain name).

2.5 Transferral of Rights to a Domain name
An applicant can transfer his rights to a domain name to a third party. Notification regarding this must be made in writing for registration by DK Hostmaster, possibly via a registrar. The transfer must contain the same information as that required for domain notification. The form which must be used to carry out such a transfer can be found on DK Hostmaster's web site.

2.6 Re-delegation of a Domain
The applicant has the right to re-delegate his domain, whenever his chooses. Notification regarding this can be sent to DK Hostmaster by the applicant himself, or via a registrar. Transfers may take place under the following conditions: 
. The nameserver involved is registered at DK Hostmaster in accordance with the rules in point 3.1. 
. DK Hostmaster has received a declaration, signed by the applicant, acknowledging the transfer. Forms for this purpose are available on DK Hostmaster's web site. 
. DK Hostmaster has received an electronic application, in a DK Hostmaster approved form, regarding the transfer, which refers to the declaration discussed in point b. Forms for this purpose are available on DK Hostmaster's web site. 
. A domain may not be put "on hold" with DK Hostmaster, in accordance with point 2.8. 
Once DK Hostmaster has received those forms named in points b. and c. then the transfer process may begin, and will usually be completed within three working days.

2.7 Deletion at Applicant's Request
An applicant can request deletion of the domain name from the domain name database by sending a signed declaration to DK Hostmaster. Forms for this purpose are available on DK Hostmaster's web site.

2.8 Incorrectly Created Domains
In the event that DK Hostmaster finds an incorrectly created domain during the automated domain check of the DK-zone, the zone contact will be asked to correct the error within 14 days. If correction is not carried out within this time then DK Hostmaster will place the domain name "on hold", and the applicant will be requested in writing to correct matters within eight weeks. If within that time corrections in the DNS for the domain are not made, then the domain name will be removed without further warning and deleted from DK Hostmaster's second-level domain name database, in accordance with point 2.4.f.

2.9 Objections to the Use of a Domain Name
DK Hostmaster can at any time demand that an applicant sends to DK Hostmaster a declaration as discussed in point 2.2.b. 
Objections to existing registrations are treated in accordance with the rules in part 5 of this rule set. Such objections will in the first instance be referred to the applicant. Neither DIFO eller DK Hostmaster are responsible for the applicant's registration or for the use of the domain name. The applicant is obliged to keep DIFO and DK Hostmaster indemnified in relation to possible disputes or legal trials regarding the rights to use the domain name, including disputes regarding underlying levels of the name.

3. Registrars and Zone Contact's Function under the .dk Domain
3.1 Approval as zone contact under the .dk domain
Any person or legal body can by lodging host-application with DK Hostmaster apply for approval to act as a zone contact under the .dk domain. Approval can be granted for each nameserver for which validation and registration is required. Forms for this purpose are available on DK Hostmaster's web site. 
Host applications must contain the following information:

. Applicant's name, company type, address and telephone number, where applicable. 
. The server name and IP number for the server concerned. 
. The name of the person, or a clearly identifyable function of the applicant, to whom correspondence may be addressed. 
. The e-mail address of the named person or function. 
Required qualifications: Notification of approval as zone contact is given if the applicant has documented to DK Hostmaster sufficient technical knowledge regarding DNS functions, including creation of domain names on a nameserver. DK Hostmaster must successfully be able to validate one or more of the domains on the nameserver for which the application is made. This is dependant upon the applicant allowing zone transfers from the name server in question to DK Hostmaster. Validation will be carried out on the domain under which the nameserver lies. 
Registration: Upon acceptance of the applicant as zone contact, DK Hostmaster will register the approved name server and notify the applicant of his rights to act as zone contact under .dk for that nameserver.

3.2 The Zone Contact's Obligations
Obligation to be contactable: The zone contact is obliged to be available to answer technical question and explain technical issues concerning the setup of the DNS server. In case of change of address from that supplied on the original application forms, DK Hostmaster must without delay be notified to this effect. 
The zone contact is obliged to conform to those control functions which DK Hostmaster may at any time deem to be necessary to ensure reliable ongoing operation of the DNS. DK Hostmaster may at will carry out tests of on or more of the .dk zones administered by the zone contact.

Registration fee: An application fee of 500 kroner plus moms is payable to DK Hostmaster in order to cover its handling costs.

Inadequate maintenance: DK Hostmaster may after written notification remove the nameserver of a given zone contact if the zone contact is guilty of inadequate maintenance of his obligations according to these rules.

3.3 Approval as Registrar under the .dk Domain
Place of application: Any person or legal body can, by submission of a registrar application apply to DK Hostmaster for the right to function as a registrar the .dk domain. Forms for this purpose are available on DK Hostmaster's web site. 
Basic conditions: Application for acceptance as a registrar may be considered after the applicant has:

. Paid a deposit of 5000 kroner. 
. provided a declaration, in which it is stated that the applicant himself is a zone contact, or that he is in cooperation with at least one other zone contact, for the server which will serve the registered domains concerned. Additionally, the applicant must agree to follow all applicable rules together with the relevant RFC rules, as described on DK Hostmaster's web site. 
The deposit named in point a. may at any time be increased up to the amount corresponding to DK Hostmaster's A/S's ongoing credit with the registrator in question. 
Qualifications: Acceptance as a registrar is conditional upon the applicant having the knowledge of the required and relevant RFC rules. In order to establish this knowledge DK Hostmaster may demand of the applicant all information regarding his, or his senior employees', DNS related experience. Equally DK Hostmaster may examine the applicant's domain and review and evaluate one or more zones (this is known as a DNS test).

Registration: Once the above conditions are met, then DK Hostmaster will register the applicant as a registrar under the .dk domain.

3.4 Registrars' Rights
Upon DK Hostmaster's acceptance of his application, the registrar gains the right to create domains for himself and for others.

3.5 Registrars' Obligations
Domain check: As part of its ongoing control DK Hostmaster regularly inspects all domains in the DK Hostmaster to ensure that the relevant DNS nameservers are correctly set up (known as Domain Checking), and to ensure that there are at least two working name servers for the domain. The registrar and/or his zone contact are obliged to ensure ongoing access for DK Hostmaster to zone transfers on those nameservers which are to be tested. 
Incorrectly set up domains. Notification concerning incorrectly set up domains will be sent via email to the zone contact for the given nameserver, as listed in DK Hostmaster's database of valid nameservers. DK Hostmaster does not use SOA records as a source of contact information.

In the event that DK Hostmaster discovers incorrectly set up domains, then the zone contact is informed of this, and he is then obliged to correct the error within 14 days.

If the error is not corrected within this time, then the domain name is placed "on hold" by DK Hostmaster, and the applicant is requested in writing to correct matters within eight weeks.

If the DNS for the domain is not corrected within this time then the domain may be removed without further warning and the domain name deleted from DK Hostmaster's database of second-level domain names.

Insufficient maintenance: DK Hostmaster can after written notification take away a registrar's right to grant domain names under the .dk domain, if the registrar in question is guilty of inadequate maintenance of his obligations according to these rules.

4. Special Rules Regarding Certain Domains
4.1 Cancellation in the interests of the general public
DIFO can decide that DK Hostmaster shall recall domain names which are already registered for use, if it is considered that there is a need to use the domain name for the good of the general public. If the domain name is in active use in connection with the applicant's daily function, then the owner may be awarded a reasonable compensation, to be paid by DIFO. DIFO's decision regarding this may be presented before the Board of Appeal.

5. Treatment of Disputes Regarding Domain Names
5.1 Board of Appeal for Domain Names
DIFO has established a Board of Appeal which makes judgements in cases such as those defined under point 5.2. 
The Boaerd of Appeal consists of three members, each of whom is appointed for a three year period. The chairman must fulfil those conditions normally required to be appointed as a judge with the rank of "Landsdommer". One of the remaining two members must have documented knowledge concerning naming and trademark rights. The remaining member must have knowledge of the Internet and Internet technologies. In cases which involve consumer demands, the Board of Appeal consists of two members representing consumer and industry interests respectively.

Members of DIFO's board cannot simultaneously be members of the Board of Appeal for Domain Names. Reappointment, and the appointment of substitutes may take place.

5.2 Scope
The Board of Appeal for Domain Names has authority to pass judgements on whether or not domain registration has contravened applicable Danish law or local rules. 
Outside of those cases which are covered by this ruleset, the Board of Appeal has no authority to make judgements regarding payment of compensation or damages.

5.3 Case Management
DIFO appoints a secretary to the Board of Appeal, who takes responsibility for the preparation of cases to be presented before the Board. The secretary may in this capacity invite the parties to attempt to reach an equitable settlement. Prior to appointment of a secretary, the Business Manager for DIFO functions as secretary for the Board. 
Complaints may be submitted to the Board secretary on paper or in electronic form. At the time of submission a fee of 500 kroner for business cases, and 200 kroner for consumer/civil cases, must be paid. Complaints will not be processed before payment is made.

The secretary ensures that the complain is shown to the the other party within two weeks of lodgement. This party's comments must then be made available to the complaintant within a similar period, and then once again the complaintant's subsequent comments made available to the other party. The Board's chairman can under certain circumstances decide that the stated two week deadlines be lengthened.

Once the second party's comments are returned, or the stated deadline has expired without the second party's comment, the secretary must make a decision as to whether the case is to be sent before the Board for judgement, or whether he should instigate a settlement procedure in which he himself should decide the outcome of the case.

In the event that a settlement procedure is instigated then the secretary can suggest to the parties that a portal covering several coordinating name or trademark rights is created, such that only the domainname can be used to establish a connection with each of the coordinating rights-holders. The party who may already have attained registration of the domainname concerned can demand reasonable compensation for surrendering their sole ownership of the domainname.

Similarly the secretary can suggest to the parties that the party who has attained valid registration of a domainname which covers a particularly familiar or valuable name or trademark, should surrender that domain name in return for reasonable renumeration from the owner of the trade mark concerned.

In the event that the case is presented before the Board of Appeal, the the Board's chairman will decide whether a decision will be delivered in written for or at a meeting of the parties. Similarly, the chairman may make a judgement as to whether additional information should be collected in order for a judgement to be made. Cases in which consumer and business representatives participate must however always be decided at a meeting of the parties.

5.4 Costs
Where the complaintant's complaint is fully or partially upheld, the paid fee is to be returned. The Board of Appeal can in these cases make a decision as to whether or not the fee should instead be demanded from the other party. Costs for case management incurred by the Board of Appeal is otherwise not demanded from the involved parties.

5.5 Publication
The Board of Appeals judgements are published on DIFO's web site. The secretary's efforts to settle disputes are treated in confidence.
